Conservatorships in the Wake of Gross v. Rell

This panel discussion will address practical strategies for avoiding conservatorships where possible, and techniques for dealing with conservatorships where they are unavoidable. The Connecticut Supreme Court’s recent rulings on the liability of conservators provides unique guidance in an area that is rarely discussed, but that is becoming increasingly important as more individuals are living longer without the capacity to manage their own personal and financial affairs. Avoiding conservatorships remains the best option, and the panelists will address the best practices to do so notwithstanding the opposition of financial institutions. Where conservatorships are necessary, the panelists will discuss the best way to protect the conserved person and the conservator from liability.
